Terms of Service
The following terms of service are subject to change and MobileMan Computer Tech Services, LLC reserves the right to modify these terms of service at any time with or without notice:
1. Fees for Services
By scheduling a service call, you understand that there will be a one hour minimum charge. You agree to pay this one hour minimum charge, even if the actual duration of the service call is less than one hour. Each additional hour will be billed at the current hourly rate, rounded to the nearest fifteen minute increment. Service rates are subject to change. Please call for our current rates.
Payment is due IN FULL upon completion of services, and/or delivery of goods. We accept cash, personal check, business check, and money orders. We do not currently accept credit cards. There will be a Twenty-Five Dollar ($25.00) service charge for all returned checks.
"An estimate as required (Section 9844 of the California Business and Professions Code) for repairs shall be given to the customer by the service dealer in writing, and the service dealer may not charge for work done or parts supplied in excess of the estimate without prior consent of the customer. Where provided in writing, the service dealer may charge a reasonable fee for services provided in determining the nature of the malfunction in preparation of a written estimate for repair. 2. "Off-site" Service
Some services cannot be completed on-site at your location. It may authorize us to remove any equipment for service, you understand and agree that items left in our custody for service or repair are not insured or protected to the amount of the actual cash value thereof and MobileMan is not responsible for loss or damage to your property as a result of theft, fire, and vandalism while such property remains with us or our representative.
3. Third-Party Vendor's Parts and Products
"Third-party vendor" refers to a vendor, retailer, or service dealer independent of MobileMan Computer Tech Services, LLC. You understand that we cannot guarantee that an item purchased from a third-party vendor is fit for any particular purpose or use. You are responsible for purchasing, reading and understanding the product documentation, and the safe and proper operation of third-party products. You understand that we may agree to install customer supplied parts which were purchased from a third-party vendor, however we are under no obligation to provide warranties for parts purchased from a third-party vendor. We will however, warrant the service work or installation we perform with respect to parts purchased from third-party vendors. (Please refer to our warranty terms which are contained in Section 4 of this agreement). You agree not to hold us liable for defective parts purchased from a third-party vendor. You understand and agree that you will be responsible for the replacement of parts purchased from a third-party vendor either through the vendor from which the parts were purchased, or through the manufacturer's warranty.
4. Limited Warranty
Please refer to the original manufacturer's warranty that comes with the purchased product. This warranty does not cover the original manufacturer's warranty or other warranties offered by MobileMan. The warranty described herein applies to services performed by MobileMan and its authorized service technicians at the customer's home, place of business, and/or private service facilities operated by MobileMan. Warranty service may be obtained by contacting MobileMan at (760) 745-5514. The customer's sole and exclusive remedy for repairs made under this warranty is through additional service work. MobileMan warrants its services to the original purchaser against defects in workmanship for a period of thirty (30) days from the date of original invoice. If materials, which were purchased from us and installed by one of our technicians, are found to be defective, we will replace these materials under the original manufacturer's warranty, if so covered. An authorized MobileMan technician must install replacement materials or this service warranty is voided. After thirty (30) days you must contact the manufacturer of the defective part directly in regards to warranty claims. It is the customer's responsibility to provide proof of purchase by presenting the original, dated invoice or receipt to MobileMan in order to obtain warranty coverage.
Some personal computer and computer peripheral manufacturer's warranties and/or third- party service contracts may require service to be performed by their authorized service technicians. Customer may choose to authorize a MobileMan technician to perform service on machines which are under such warranties, at the risk of the such warranties and/or service contracts being voided. It is your responsibility to determine what is covered and what is not covered by the manufacturer's warranty and/or third-party service contracts prior to authorizing MobileMan to provide any services. If you elect to have MobileMan perform services regardless of the manufacturer's warranty or third-party service contract terms, MobileMan will not be liable for any resulting nullification and/or void of such warranties and service contracts.
MobileMan recommends that the customer perform a complete system back up of all of the information on the hard drive of the computer that will be serviced prior to any installation and/or services performed by MobileMan. You understand and agree that prior to any service performed on your computer, it is your responsibility to make sure that your computer system has been completely backed up. MobileMan is not responsible for loss of data or information that is on your computer.
Coverage Exclusions: This warranty does not cover damage to any item, if in our opinion, improper customer assembly, modification, negligence, and/or improper use or abuse has caused damage. This warranty does not cover new computer problems or issues that are unrelated to prior services. MobileMan reserves the right to determine whether or not any computer problems/issues that may arise are new issues unrelated to previous services performed by MobileMan. If it is determined that such issues are new and unrelated to prior services, or if thirty (30) days have passed since original service, such issues will be addressed as a new service request and you will be charged fees for the services performed. This warranty excludes software, and parts that were not purchased directly from MobileMan by the customer. This limited warranty gives our customers specific legal rights; you may also have other rights provided under California state law.
IF THE SERVICES ARE NOT PERFORMED AS WARRANTED HEREIN, THE CUSTOMER'S SOLE REMEDY WILL BE REPAIR OR REPLACEMENT, AT THE OPTION OF MOBILEMAN AS FURTHER PROVIDED ABOVE. IN NO EVENT WILL MOBILEMAN BE LIABLE FOR DAMAGES, LOST DATA, LOST REVENUES, LOST WAGES, LOST SAVINGS, OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM PURCHASE, ASSEMBLY OR INABILITY TO USE ANY PRODUCT, AS A RESULT OF SERVICES PERFORMED.
WARRANTY NOTICE
"A buyer of this product in California has the right to have this product serviced or repaired during the warranty period. The warranty period will be extended for the number of whole days that the product has been out of the buyer's hands for warranty repairs. If a defect exists within the warranty period, the warranty will not expire until the defect has been fixed. The warranty period will also be extended if the warranty repairs have not been performed due to delays caused by circumstances beyond the control of the buyer, or if the warranty repairs did not remedy the defect and the buyer notifies the manufacturer or seller of the failure of the repairs within 60 days after they were completed. If, after a reasonable number of attempts, the defect has not been fixed, the buyer may return this product for a replacement or a refund subject, in either case, to deduction of a reasonable charge for usage. This time extension does not affect the protections or remedies the buyer has under other laws."
